What if I don’t meet all the criteria in Balens’ statement of fact?

If you do not meet all the criteria listed, you must contact Balens directly before relying on your insurance cover.

Your YogaPros member insurance documents (from Balens) include a statement of fact, which outlines the conditions you must meet to be insured under the policy. You will find these listed on the cover letter which you receive with your insurance cover. They are also noted in our Terms of Use in section 8.

Why this matters

The statement of fact forms part of your insurance agreement.

If any of the information is incorrect, incomplete, or does not apply to you, it could affect the validity of your cover.

  • You should review the statement of fact carefully

  • If anything does not apply to you, you must not ignore it

  • You need to provide additional information or clarification to Balens, to ensure the policy meets your needs

How do I contact Balens?

UK Statement of Fact 

To obtain and maintain cover, you must be able to confirm the following statement of fact:

  • You have never been convicted of, or charged (but not yet tried) with, any criminal offence other than motoring offences or offences that are spent under the Rehabilitation of Offenders Act 1974.
  • You have never had an insurance proposal or renewal declined or cancelled, a policy voided, withdrawn or suspended, or had special terms imposed by any insurer.
  • There have been no claims or incidents that have, or could, give rise to a claim involving negligence, error or omission, and you are not aware of any circumstances that may lead to such a claim or legal action against you.
  • You or any director or partner have never been the subject of, and do not have pending, any winding‑up order, receivership, debt relief, liquidation, administration, County Court Judgment (CCJ), company or individual voluntary arrangement, bankruptcy or insolvency proceedings.
  • You have read, understood and agree to accept Balens’ Terms of Business letter.

If you cannot confirm this statement of fact, you must provide full details to Yoga Pros. They will then contact Balens, as a referral to insurers may be required.

Irish Statement of Fact 

To obtain and maintain cover, you must be able to confirm the following statement of fact:

  • You have never been convicted of any criminal offence other than motoring, nor offences that are spent under the Rehabilitation of Offenders Act 1974, nor have any prosecutions pending.
  • No insurer providing cover for your business activities has ever cancelled, declined or refused to renew, or accepted the risk at special terms.
  • You have read, understood, and agreed to accept Balens Europe B.V. Terms of Business letter (Appendix 2). Please note that the Terms of Business can be downloaded on our website.
  • There have been no claims or incidents which have or could give rise to a claim under a policy involving negligence, error or omission, nor are you aware of any circumstances which may cause such a claim or suit to be made against you.
  • You or any Principal, Director, or Partner have never, under a current or any previous trading titles have, been declared bankrupt or insolvent or been the subject of bankruptcy proceedings or an individual voluntary arrangement or been subject to a County Court Judgment, or are there any proceedings pending.

If you cannot confirm this statement of fact, you must provide full details to Yoga Pros. They will then contact Balens, as a referral to insurers may be required.
