What is the importance of insurance?

Accidents happen! It's all fine and well saying that something bad will never happen, but you never know. It's also essential to put your students' safety first and foremost. 

Are you Teaching or Adjusting Others During Your Teacher Training?

Then join as a Trainee Teacher, and you can get insurance included in your membership (UK and Irish residents only)! We can introduce you to Balens who can insure you while you adjust other students and cover classes during your time as a Trainee Yoga Teacher. The cost of trainee insurance is a one-time payment of £25, covering you for a maximum of 18 months or until you graduate (whichever comes first).

What is Professional Liability & Malpractice Insurance?

Professional Liability & Malpractice Insurance helps protect you if someone claims you have been professionally negligent, have breached your professional duty or have caused injury or harm as a result of a treatment or advice provided. This will cover claims or allegations made against you during the course of running your Yoga and Meditation classes.

If a third party alleges that your professional actions caused them loss or harm, this insurance can:

  • Cover damages or compensation you are legally required to pay; and

  • Cover the legal costs and expenses of defending you against the claim.

Cover is always provided subject to the full policy terms and conditions.

What is Public Liability Insurance?

Public Liability Insurance helps protect you if someone claims you have caused them injury or damaged their property in a way that is not directly linked to your professional treatment or advice.

For example, this part of the policy can respond if a third party (such as a client or visitor) alleges that, due to your negligence, they have suffered:

  • Accidental bodily injury (For example: Tripping over Yoga mats that you are waiting to put away)
  • Accidental damage to their property (For example: a person attends your yoga class and puts their glasses on a side table. During the session you accidentally knock them to the floor while moving your equipment, and the glasses are broken.

If you are found legally liable, this insurance can:

  • Cover damages or compensation you are legally required to pay; and
  • Cover the legal costs and expenses of defending you against the claim.

What is Products Liability Insurance?

Products Liability insurance helps protect you if a product you sell or recommend as part of your business is defective and causes injury or harm to a third party or causes property damage. Liability could attach to you even if you are not responsible for manufacturing the product.

If you are found legally liable, this insurance can:

  • Cover damages or compensation you are legally required to pay; and

  • Cover the legal costs and expenses of defending you against the claim.

Cover is always subject to the full policy terms and conditions.

What is Commercial Legal Expenses cover and why is it included in my policy?

Commercial Legal Expenses cover is provided by ARAG plc and is included as standard as part of the insurance package arranged for Yoga Pro’s members.

It provides:

  • Cover for legal defence costs against criminal allegations
  • Pre‑disciplinary and disciplinary hearings cover
  • Jury service and court attendance cover
  • Tax protection cover relating to a tax enquiry, an employer compliance dispute and/or a VAT dispute
  • Unlimited access to legal and tax helplines
  • Access to a counselling service

The Commercial Legal Expenses policy has a limit of liability of £100,000 per claim.

Please note: Any claims or incidents that may be covered under this policy should be notified to Balens in the first instance.

Where can I teach yoga?

The policy is mobile, which means you are covered to practise in line with your qualifications within the territorial limits of the policy.

This includes, for example:

  • Working from home
  • Teaching in studios
  • Working in gyms

If you are unsure whether a specific location falls within the territorial limits, please check your policy wording or contact Balens.

What techniques am I insured to practice?

You are insured to practise Yoga and Meditation under the policy. This includes activities such as:

  • Pregnancy Yoga
  • Children’s Yoga
  • Yoga Therapy
  • Sup Yoga (please contact Yoga Pro’s as condition/endorsement applies)

Cover is always subject to you holding a suitable qualification for the techniques you are offering.

Some activities are not included under the master policy, for example:

  • Aerial Yoga
  • Other activities outside Yoga and Meditation. For example Massage or personal training.

If you require cover for these or other additional techniques, you will need to take out extra cover under the multi‑therapy policy.

Do I need to keep paying for my insurance once I have stopped practicing?

No. The policy is arranged on a ‘claims occurring’ basis. This means it will respond (subject to the standard terms and conditions) as long as the policy was in force at the time the incident occurred.

This means, you do not need to pay for ‘run‑off’ cover once you have stopped practising.

 

I am thinking of moving my insurance cover to Balens, would you pick up any claims from past work that are discovered once I’ve taken out the policy?

Yes. Provided you:

  • Had insurance in place at the time you carried out the session; and
  • The activities are covered under your current Balens policy,

the Balens policy includes retrospective cover. This means the policy can respond to past work, as long as you were not aware of any claim or incident before the Balens cover started.

How much insurance cover is provided by the insurance policy / what is the limit of indemnity?

The Combined Liabilities policy provides a limit of indemnity of £6,000,000 per member. This applies any one claim, with unlimited claims per year, except for the Products Liability section, which is in the aggregate.

If you wish to increase the limit of indemnity to £10,000,000, please contact Balens. An additional premium will apply, and we will need to know the reason for the requested increase.

The Commercial Legal Protection policy has a limit of indemnity of £100,000.

Does the insurance policy cover me to work abroad?

The policy is suitable for UK residents and covers temporary trips abroad, excluding the USA, Canada and their territories. There is no time limit to the number of days you can work abroad under the policy, but you must remain a UK resident.

This can include work such as classes at a UK forces base overseas, provided the base is regarded as UK territory.

Please note: Any offshore work (for example, on yachts or cruise ships) is on a referral-only basis, and you will need to contact Balens separately if this cover is required.

Does the insurance policy cover me to run classes online?

Yes. The policy covers live online/virtual classes worldwide, excluding the USA and Canada. You must comply with the Record Keeping conditions under the policy.

If you are selling access to pre‑recorded classes, this is treated as a product. These are covered under the policy within the territorial limits. If you need cover for selling these products to the USA or Canada please contact Balens.

Recorded promotional material (for example YouTube videos or Instagram posts) is covered as standard, provided that:

  • It is directly related to your qualifications
  • It is free of charge
  • The content is kept up to date in line with your training and best practice guidelines.
